Our current processing times for all "RTS" items is 3 to 5 business days. Processing times for "Made to Order" Items are 10 to 14 business days. If you order items with different processing times, all items will ship together with the item with the longest processing time. "Processing Times" do not include shipping transit time. By purchasing items from this website, in store, or by any other means of sale from Mibbecakes Creations LLC. (including but not limited to through the Facebook VIP group/sales, social media direct messages, vendor shows and events, e-mail, direct invoice, etc.) - you are agreeing to ALL of Mibbecakes Creation's policies and terms and conditions listed here. We are not responsible if you purchase and have not taken the time to read all available information and terms of service.

This website, and our retail location is operated by Mibbecakes Creations LLC, also referred to as Mibbecakes Creations. Throughout the site, the terms “we”, “us” and “our” refer to Mibbecakes Creations or Mibbecakes Creations LLC. Mibbecakes Creations LLC offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

SECTION 4 - PROCESSING AND SHIPPING INFORMATION:
All items "ready to ship" - have a 3 to 5 business day* turnaround time. - Means these items are fully completed and ready to be shipped out. No waiting to make.

All items "ready to press" - have a 5 business day* turnaround time. - It means that the shirt blanks needed to create the items in the listing are dyed/bleached and pre-created and are on hand, as well as the design is on hand, all that is needed is the finishing press.

All items "made to order" -  have a 10 to 14 business day* processing and turn around time. - All orders must be paid prior to me ordering your shirts. Processing time begins at the time of payment RECEIVED. Processing time may vary and be extended depending on supply difficulties due to manufacturer and supply line issues. Please understand that I may have your shirts ready to go and in stock, however, if they do need to be bleached, weather may also effect or extend the turn around time. Should your turn around time need to be extended due to either of these issues you will receive notification. *This does NOT apply to bulk orders, or orders needing custom artwork. Please, see more information on Bulk orders below.

You understand that processing times may be extended at anytime at no fault of Mibbecakes Creations, due to delays and/or shortages from supplies due to but not limited to natural disaster, pandemic, etc.

Mibbecakes Creations is not responsible for delays during shipping and transit times. Processing times do not include Shipping & Transit times. These time frames are based on services selected, and carriers chosen.

*Business days are defined as but not limited to: 
11 AM to 6 PM Wednesday through Saturday
Excluding Sundays, Mondays, Tuesdays and Federally Recognized or "Bank" Holidays - We typically do not answer messages or calls outside of business days/hours. Should we choose to do so, this does not change your processing time and/or amount of business days estimated for the completion of your order.

Regular "In Shop" business hours may vary by season, and can always be found on our front door, on our Facebook page and/or group. They can be requested via Facebook message at any time.

Any days posted on social media that we are showcasing at a craft show, flea market, fair festival or any other live marketplace where we are operating outside of our normal crafting space; that fall outside of the constraints of the weekend, will not be considered business days. (i.e. midweek travel or set up)

Other exclusions may apply without notice and are subject to change at any time. 

Shipping and Transit times are approximate and based on estimates given by the USPS. They are not in any way backed or guaranteed by Mibbecakes Creations. You understand that by choosing any certain form of shipping you are doing so at your own risk and delivery times will not be guaranteed.

***CUSTOM ORDERS SINGLE AND BULK***

Custom orders will generally hold a 14 to 21 BUSINESS DAY processing time. Please see the beginning of Section 4, for more information on business days at our business. Once production has begun or materials have been ordered, custom orders are all sales final. There will be no refunds available.

**BULK ORDERS**
Defined as orders of shirts in quantity of over 25, will be handled on a case by case basis, and processing time may be additional, depending on the current work load of normal business within the store. Bulk orders are all sales final once production has begun and/or materials have been ordered.

PROCESSING TIME BEGINS:
At the time of payment being received in full.
All "PRINT READY" artwork has been received and has been approved by Mibbecakes Creations staff as being "Print Ready".

*Print Ready Artwork is defined as: Being of at least 3600 x 3600 pixels, and a resolution of at least 300 DPI. Files such as PDF, JPEG, Adobe Illustrator Files and/or Screenshots are not acceptable or print ready forms of artwork. Artwork MUST be submitted as a PNG or SVG file WITHOUT a background to be considered "Print Ready."

*If Mibbecakes Creations has to await the delivery of or "track down" artwork from another designer or establishment, and it is not considered "print ready" upon receiving, processing time will not begin until artwork is received in or has been altered to be "Print Ready."

If Mibbecakes Creations has to trace, alter, design or otherwise create artwork for your order, this will accrue additional charges at a $25.00 base fee, and $5 for each additional hour that is needed to create said artwork; and may extend your processing time indefinitely.

**VIRAL VIDEO CLAUSE** - items ordered via a social media post, share, live or advertisement of any kind, and said item has been considered to have "gone viral" (i.e. an order quantity outside of normal expectations or capabilities has been received.) you understand that your turn around time, for said item, may be effected and extended due to production capabilities. All orders will be created in the order received, and orders outside of the turnaround time will receive communication as such, at which time the customer may choose to either accept the extended turn around time, or receive a refund for their order.

Shipping and Pick Up:
Local Pick Up is the sole responsibility of the buyer. If you choose pick up as an option, you understand that you must come to us for pick up and that we will not meet you at a central location, unless otherwise specified. You will receive a notice via the e-mail provided, once your items are ready for pick up. Your items must be picked up at 8523 State Street in Millington, during our normal business hours. Please, see section 4 for more information on our business hours.

**After you have been notified that your item is completed and ready to pick up, you have 3 weeks or 21 calendar days to pick up your item. If it is NOT picked up and no other arrangements have been made; your items will be considered abandoned and may be restocked and/or sold, with no refund.** The purchase price of your items paid will then be considered a storage and restocking fee.

All discrepancies, problems, damage or other issues must be brought to the attention of the designer/seller within 48 hours of delivery for return or exchange options. Returns will be accepted only on unused/unworn new in/on packaging/tags attached and items and in new condition, and only under certain rare instances that the item is incorrect, is not what the customer ordered, or got mixed up. Any returns accepted must be return shipped at the customers expense, and must be received before any replacement product or refund is sent out. Any other issues must be brought to our attention within 48 hours. Defects will be on a case by case basis and at the discretion of management.

You have the option to purchase Route Package insurance at check out; on any items shipped via mail. Should you forgo Route Package insurance, you do so at your own risk, and relinquish your right to any refund for items lost or damaged during the shipping process. Should your item be lost or damaged with Route insurance, you understand that it may be your responsibility to file a claim WITH ROUTE to retain a refund or replacement product. 

We request that any discrepancies be brought to our attention before being brought forth to others on social media or otherwise, so that we might make an attempt to correct any issues first, in accordance with these Terms and Conditions.

SECTION 5 - MERCHANDISE AND INFORMATION AND CARE INSTRUCTIONS:

You understand that Mibbecakes Creations merchandise and apparel are created with various types of fabrics, chemicals, dyes, inks and other materials. You acknowledge that Mibbecakes Creations is not responsible or liable for any skin irritations, allergic reactions to or injury from any of our items. It is highly recommended that all items be washed before wearing.

Because items are made by hand, it is impossible to prevent minor imperfections such as random dye marks, bleach runs, discolorations, paint splatters etc. Colors may vary from what you see on your screen. It is impossible to make two shirts identical. Although we use the same technic on each style shirt, no two shirts will ever be exact.

All items are inspected before being sent out.

Any stiffness left in painted shirts will relax upon laundering.

By purchasing our items you understand that we offer care specific care instructions for those items. Those care instructions help maintain the longevity of your items and designs. Improper care or care failing to follow those specified instructions may cause damage to your item or faster than usual "wear and tear'. You understand that we are under zero obligation to replace or refund your money for items destroyed by improper care.

It is highly recommended that all hand crafted items are washed separately in cold water on their first wash.


After that always wash in cold water and hang dry for maximum longevity of your items and designs!

Drying your items could risk cracking, peeling or destruction of your items! We do not recommend machine drying your hand crafted items!

It is recommended that you do not use fabric softeners or dry clean when laundering your items, and iron on medium to low, and on reverse side only.

**All of our items are dried at least once during the creation process. So if you are someone who never dries their items for fit, it is suggested you order one size up!**

***SUBLIMATION DESIGNS SHOULD BE EXPECTED TO FADE WITH WASHING! Some may not fade right away, but if they do, please understand that this is normal for this process on any blend shirt other than 100% polyester. Shirts should be washed separate on first wash. Following proper care instructions will help maintain longevity of your designs!** Shirts with higher polyester counts are less likely to fade.

**Tie Dye/Painted Designs - Although they are thoroughly laundered at least once during the process, it is best to wash separately on first wash, just in case. Color transfer is not likely, but still possible. Shout brand "color catchers" are also a good recommendation to prevent color transfer to white parts or other articles of clothing.

**HTV designs should not be dried.

**Screen-prints may be tumble dried on low, inside out. To reduce the risk of cracking or peeling, and increasing the longevity of your design, we highly recommend hang drying. If you choose to dry your garments, you do so at your own risk.

SECTION 6 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Mibbecakes Creations LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

By purchasing/ordering items from Mibbecakes Creations and/or Mibbecakes Creations LLC, you are acknowledging that you have read and understand these terms and agree to them. 

SECTION 7 - RETURN POLICY

All Custom orders and "Build Your Own" items are all sales final. Please, be sure to try items on and/or double check sizes before purchasing or creating. Artwork previews will be sent, once approved, and items are created, all sales are final. This includes but is not limited to single shirt requests up to bulk orders.

Last Chance tees are also Final Sale.
General Merchandise will be returned or exchanged on a case by case basis.

Ready Made shirts and Millington School/Cardinal Spirit Wear items may be EXCHANGED for in store credit or an item of equal or lesser value, IF AND ONLY IF:

Item is in new condition with the tags attached.
Has not been washed or worn.

All Vendor items are final sale within Mibbecakes Creations. If you should be seeking a return or exchange for any reason, you must contact the original vendor/creator of that item. Mibbecakes Creations is not responsible or liable for any defect, allergy or complication set forth from a vendor item.

This is included but not limited to: Any items sold retail within our shop, any items invoiced for and shipped, any items out sourced through a 3rd party for delivery.
